Marijuana “Gifting” Banned as Vermont Legalizes Possession but Not Sales

(AP) — Vermont Attorney General T.J. Donovan has clarified that the sale of marijuana, even when it is given as a “gift with purchase,” is still illegal, despite the recent legalization of marijuana possession.

Vermont legalized the possession of one ounce of marijuana on July 1st, 2018, but did not legalize its sale or distribution. Donovan clarified that any purchase, even the purchase of another item “with a purported gift of marijuana,” continues to remain illegal.

Businesses in the Burlington area had begun “gifting” marijuana with the purchase of a courier service, arguing there was a loophole in the law and that people were not actually purchasing marijuana.

Last week, groups opposed to the legalization of marijuana called on Donovan to clarify whether this practice was legal.
