El Paso Approves New “Cite & Release” Marijuana Policy

The El Paso City Council voted 7-0 to approve a progressive policy for punishing people found in possession of marijuana.

The Texas border city has been operating with a “first chance” policy, thus allowing first-time offenders the chance to keep a clean criminal record by only paying a $100 fine and serving community service, ABC 7 KVIA reported.

But now El Paso will also implement the “cite and release” proposition for marijuana possession which will leave offenders with a citation and keep them out of jail.

“The person is not being immediately arrested and that of course if very beneficial to the police department because they are not losing hours waiting to book someone or process someone,” said an El Paso County Court Judge.

Arizona legalized marijuana for recreational use in November 2020. The law allows adults aged 21+ to purchase, possess and use cannabis. State-licensed cannabis dispensaries began selling recreational marijuana in early 2021. There are over 150 dispensaries in Arizona — a majority of them are in populous areas such as Phoenix, Tucson and Flagstaff. Recreational cannabis delivery services began operating in 2024.
