An Ohio man caught with 91 pounds of marijuana will not face charges because the state currently doesn’t have the proper testing equipment to detect the exact amount of THC in the man’s plants, so they can’t determine if the plants are hemp, which is legal in Ohio, or marijuana, which is illegal.

Ohio labs, other than those specifically licensed to test medical marijuana products, can only detect THC, but not the exact amount of the substance, ABC News 5 Cleveland reported. Law enforcement officers say that during traffic stops it’s pretty much impossible to tell the difference between marijuana and hemp.

State prosecutors were told by Ohio Attorney General to not bring marijuana-related cases to him. Instead, law enforcement will have more time to spend on violent crimes.

Ohio should have sufficient lab testing equipment within the next few months.

Arizona legalized marijuana for recreational use in November 2020. The law allows adults aged 21+ to purchase, possess and use cannabis. State-licensed cannabis dispensaries began selling recreational marijuana in early 2021. There are over 150 dispensaries in Arizona — a majority of them are in populous areas such as Phoenix, Tucson and Flagstaff. Recreational cannabis delivery services began operating in 2024.
