Phoenix Dispensaries

This week, a judge barred Arizona from being able to deny certificate renewals to dispensaries that have not yet received approval to operate because they weren’t ready to open for business.

Now, Arizona’s medical marijuana program regulators, the Arizona Department of Health Services, will have to rewrite the rules imposing a deadline for would-be operators of dispensaries to apply for their annual renewal certificates.

Will Humble, Director of the Arizona Department of Health Services said they will accept renewal applications from all current dispensary certificate holders whether their dispensary is open or not.

Many would-be dispensary owners cited delays from uncertainties caused by legal challenges with opening a medical marijuana business.

This ruling will allow dispensary certificate holders the time to properly set up and open their dispensaries. Furthermore, it means that more dispensaries will be opening in Arizona in the near future.

Arizona legalized marijuana for recreational use in November 2020. The law allows adults aged 21+ to purchase, possess and use cannabis. State-licensed cannabis dispensaries began selling recreational marijuana in early 2021. There are over 150 dispensaries in Arizona — a majority of them are in populous areas such as Phoenix, Tucson and Flagstaff. Recreational cannabis delivery services began operating in 2024.
